1.1 Registration. To use the Service, you must create an account using a valid email address, your name, and a password. You are responsible for maintaining the confidentiality of your login credentials.
1.2 Accuracy. You must provide accurate and complete information and keep it updated.
1.3 Eligibility. You must be at least 13 years old to use the Service. If you are under 18, you confirm that you have obtained the consent of a parent or guardian.
1.4 One account per person. You may not create multiple accounts to circumvent our policies.
2.1 Ownership. You retain all ownership rights in the content you upload, publish, or create on Trail Tales ("Your Content"). We do not claim any ownership over Your Content.
2.2 Licence to us. By publishing content on Trail Tales, you grant us a non-exclusive, worldwide, royalty-free, fully paid-up licence to host, store, reproduce, display, and distribute Your Content for the sole purpose of providing and operating the Service. This licence includes the right to:

Upon receiving a valid notice, we will review the content and, if appropriate, remove or disable access to it expeditiously in accordance with the Electronic Commerce (EC Directive) Regulations 2002. We may contact you if we require further information.
We reserve the right to terminate the accounts of repeat infringers.
If you believe content on Trail Tales is defamatory, you may send a notice of complaint as described in Section 4 above. Under the Defamation and Malicious Publication (Scotland) Act 2021, we are not considered a publisher of user-generated content. However, upon receiving a valid complaint we will review the content and remove it if appropriate. Scottish courts have the power to order the removal of defamatory statements under section 30 of that Act.
6.1 Our rights. The Service, its design, and its underlying software (excluding user content and open-source components) are owned by Ben Marshall and are protected by copyright and other intellectual property laws.
6.2 User content. As stated in Section 2, you retain ownership of Your Content. Photos are protected as artistic works under the Copyright, Designs and Patents Act 1988. You must not upload photos you do not own or have permission to use.
Trail Tales is provided "as is" and "as available". We make no guarantees regarding uptime, availability, or the integrity of your content. We will use reasonable endeavours to communicate planned changes and disruptions in advance.
We may change, suspend, or discontinue any feature of the Service at any time. We will endeavour to give reasonable notice of significant changes where practicable.
To the fullest extent permitted by applicable law, neither Trail Tales nor Ben Marshall shall be liable for:
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
You should not rely on Trail Tales as your primary backup for GPS tracks, photos, or other content.
9.1 By you. You may delete your account at any time through your account settings or by contacting us. We will delete your personal data in accordance with our Privacy Policy.
9.2 By us. We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or if required by law. We will notify you where practicable.
9.3 Effect of termination. Upon termination, your content may be removed from the Service. We are not obliged to retain or provide you with copies of your content after termination, but we will make reasonable efforts to provide a copy if you request it before or within a reasonable period following termination.
These Terms are governed by the laws of Scotland. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Scottish courts.
We may update these Terms from time to time. If we make material changes, we will notify you by email and provide a summary of the changes. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
